An Orange Hill man who pleaded guilty to a burglary charge but disputed the facts presented in court will be tried by a different magistrate. 

Dimitri Billingy, a 21-year-old labourer, pleaded guilty before Magistrate Kaywana Jacobs at the Georgetown Magistrate’s Court, to a charge that on May 31, at Orange Hill, he entered the dwelling house of Amorel Sam as a trespasser with intent to commit an offence, to wit, theft.

Prosecutor, acting Sergeant of Police Corlene Samuel, told the court on the date at 9 a.m., Sam’s brother, Corporal 540 Sam, received information that Billingy was seen spinning the lock at Amorel’s house.

Corporal Sam visited his sister’s property and found Billingy climbing down from some blocks under his sister’s bedroom window.

Corporal Sam identified himself to Billingy, informed him of his observation and pointed out the offence of burglary.

Billingy told Corporal Sam, “Darryl, you see me ah come out the house?”

Corporal Sam told Billingy that he had seen him with his hands coming through the window.

Corporal Sam arrested Billingy on suspicion and handed him over to the Georgetown Police Station. PC 425 Arrindel investigated.

In mitigation, Billingy told the court he was drunk and slept on Amorel’s porch. 

He said he was spinning the doorknob because he was hungry and wanted something to eat.

Billingy said he had gone to urinate behind the house when Corporal Sam grabbed him.

“So, you are disputing the facts to say what was read was not what really happened?” Jacobs said.

“From what he’s saying, I think I am going to enter a not guilty plea,” the magistrate continued.

Jacobs transferred the case to the Calliaqua Magistrate Court for June 10.

Billingy was placed on EC$2,000 bail with one surety and ordered not to have any contact with the virtual complainant.
