A 27-year-old Mt Bentick, Georgetown man on Monday pleaded guilty to a charge of assault occasioning actual bodily harm, resulting in his first conviction.

Kimron Lavia pleaded guilty at the Georgetown Magistrate’s Court to the charge that on Nov. 4, 2025, at Mt Bentick, Georgetown, he assaulted Dequano Joseph, causing actual bodily harm.

The facts, read by Police Constable 977 Fergus, are that the defendant and Joseph are neighbours.

On Nov. 4, 2025, Joseph was cleaning his yard and this seemed to annoy Lavia and his brothers.

An argument ensued between the parties and Lavia took up a bottle and pelted it at Joseph, which missed him, struck a house, and broke.

Lavia then took up a stone and threw it at Joseph, injuring his left thigh.

Lavia’s lawyer Grant Connell, did not dispute the facts but told the court Joseph had charged at the brothers with a cutlass before the stone was thrown.

He said the stone barely grazed Joseph, adding that Lavia was remorseful.

The prosecutor, Inspector of Police Corlene Samuel, asked the court to hand down the sentence it considered appropriate.

Magistrate Kaywanna Jacobs ordered Lavia to pay EC$300 in compensation by Jan. 30 or spend three months in prison.

Lavia was also fined EC$200, payable by Feb. 13, or face two months in prison.

He was also placed on a nine-month bond. If he breaches the bond, he must pay the court EC$900 forthwith or serve a four-month prison sentence.

PC 573 Young was the investigator.
