A security guard who says he usually posts sex videos of random people to his WhatsApp status and his co-worker who sent him videos of her boyfriend having sex with her and four other women separately have been charged a total of EC$45,000 for their crimes.

Jayfornia Holder, 24, of Upper Cane Hall has until March 31, 2026, to pay the court EC$20,000 in fines imposed under the country’s cybercrime law, if she is to avoid one year in prison.

Otis Gloster, 29, of Glen, was given until June 30, 2026, to pay a total of EC$25,000 or face the same prison term.

The defendants each have to pay portions of the fines by dates set by Senior Magistrate Tammika Mc Kenzie at the Kingstown Magistrate’s Court on Friday.

The magistrate also imposed one-year prison sentences on each of the defendants, but suspended them for two years.

This means that if any of the defendants commits a crime within the next two years, he or she could be made to serve the sentence, in addition to any penalty the court imposes for that other offence.

Holder pleaded guilty to a charge of illegal access to a computer system, namely a cellular phone belonging to a 27-year-old chauffeur.

She and Gloster each pleaded guilty to a charge of violation of privacy, sexual harassment by electronic communication and cyberbullying in relation to each of the three women who appeared in the sex videos.

The women are a 22-year-old assistant teacher, a 23-year-old sales clerk, and a 19-year-old store attendant.

The facts of the case, as read by Police Constable 196 Constantine, are that the chauffeur and Holder had been in an on-and-off relationship for some time, during which they broke up on several occasions because of his infidelity.

On Oct. 30, about 8:30 p.m., Holder and the chauffeur were returning from a restaurant when his phone rang.

He ended the call and Holder became suspicious and ask him who had called. He said it was one of his “soldier”. Holder had her doubts.

That night they ate, had sex and then the chauffeur went to sleep. While he was sleeping, Holder went through his phone and saw it was the assistant teacher who had called.

This made her even more suspicious so she opened his WhatsApp messages and saw the chauffeur telling the assistant teacher, “can’t talk now, call me tomorrow”.

Holder went through other messages and saw her boyfriend telling one “Kitty”, “yo wicked because yo na give me no cat”.

This made Holder mad so she put down his phone.

Then, on Oct. 31, Holder confronted her boyfriend about the messages that she had seen on his phone and told him that their relationship was over.

On Nov. 1, about 8:43 p.m. the chauffeur was at home when he received a WhatsApp call from the sales clerk asking him, “Why is there a sex video of us circulating?”

At 8:46 p.m. he received another call from the assistant teacher, saying, “Take it down! Take down the video!”

After he hung up his phone, he went to his Google Photos and saw that all the sex videos on his phone with Holder had been deleted.

He contacted Holder and asked why she had posted five videos with him having sex with five different females but she denied the allegations.

The four virtual complainants made reports to the police and PC 871 Lewis conducted an investigation that led to Holder and Gloster being taken into custody.

Holder volunteered a statement in the presence of Justice of Peace Albert Chewitt admitting to the offences.

Gloster opted not to give a written statement but told the police in the presence of Chewitt, “Yes. She send the videos them to my phone. I post them on me WhatsApp status and people start to ask me for them so me send the videos them give them.”

In his caution statement to police, Gloster said that Holder had sent him separate videos of her boyfriend having sex with her and four other women. 

He posted the four videos of the other women to his WhatsApp status but not the one of Holder. 

In mitigation, Stephen Williams, Holder’s lawyer, told the court that she is the mother of two children — aged 7 and 5 — who is employed as a security guard and caregiver.

The lawyer noted that she had no previous conviction, pleaded guilty and had not wasted the court’s time.

He said Holder had cooperated with the police, adding that she was throwing  herself at the mercy of the court.

The lawyer said she understood that the matters are very serious and asked if the court imposes a fine that the Holder be given time to pay.

Gloster, who did not have a lawyer, asked the court to give him time to pay the fine.

Both defendants apologised to the three virtual complainant who attended the hearing.
